Terms of Service

1. Acceptance of terms
Welcome to Polisht ("Service"). These Terms of Service ("Terms") govern your access to and use of polisht.ca, our mobile apps, and any related services operated by Polisht (collectively, "we", "us", "our"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. What Polisht is
Polisht is an AI-assisted optimization tool for YouTube creators. It analyzes YouTube videos and proposes titles, descriptions, tags, chapter timestamps, thumbnails, and captions. The Service pushes approved changes to YouTube on your behalf via the YouTube API.
Polisht is provided "as is" and "as available". The Service requires you to grant OAuth access to your YouTube account. You can revoke this at any time via Google's security settings.
3. Eligibility
You must be at least 13 years old (16 in the EU/UK) and have a valid YouTube account to use Polisht. By using the Service, you represent that you meet these requirements and that the YouTube channels you connect are owned by you or that you have express written permission to manage them on behalf of the owner.
4. YouTube API services
Polisht uses YouTube API Services. By using Polisht, you agree to be bound by:

5. Acceptable use
You agree NOT to use Polisht to:
- Violate any law or third-party rights
- Spam, scam, mislead, or deceive YouTube viewers
- Manage YouTube channels you do not own or are not authorized to manage
- Generate or apply content that violates YouTube's Community Guidelines (hate speech, harassment, child safety violations, etc.)
- Reverse-engineer, decompile, or scrape the Service
- Use the Service to compete with us in offering substantially similar functionality
- Exceed your tier's video quota by creating multiple accounts to circumvent it
- Probe, scan, or test the Service's vulnerability without our express written consent
We reserve the right to suspend or terminate accounts that violate these rules.
6. Your content
You retain all ownership of the YouTube videos you analyze with Polisht ("Your Content"). By using Polisht, you grant us a limited, revocable, non-exclusive license to:
- Read Your Content via YouTube API to generate analyses
- Store analyses, transcripts, and AI-generated suggestions in our database
- Process audio/frames temporarily during analysis
- Push your approved changes back to YouTube on your behalf
This license terminates when you delete the analysis or your account. We do NOT claim ownership of, sell, redistribute, or train AI models on Your Content.
7. AI-generated content
Polisht uses third-party AI models (Anthropic Claude, OpenAI Whisper, Google Gemini including Nano Banana, and similar) to generate suggestions. AI output:
- Is provided as suggestions, not finished products. You are responsible for reviewing every suggestion before applying it.
- May occasionally be inaccurate, biased, or inappropriate. We urge you to review carefully.
- Becomes "Your Content" the moment you approve and apply it — you take full responsibility for any AI-generated content you publish to YouTube.
Polisht is not responsible for the accuracy, legality, or consequences of AI-generated content you choose to publish.
8. Pricing, quotas, and refunds
Polisht offers a free tier (limited number of videos per month) and may offer paid tiers. Pricing and quotas are published on the website and may change with 30 days' notice for active users.
Refunds: Paid tier subscriptions can be cancelled at any time. Refunds are issued on a case-by-case basis within the first 14 days of a new subscription; after that, you retain access until the end of your billing period but no refund is issued. Annual subscriptions: prorated refund within the first 30 days, no refund after.
We reserve the right to limit, suspend, or rate-limit access to prevent abuse, manage costs, or maintain service quality.
9. Service availability
We aim for high availability but do not guarantee uninterrupted service. Polisht depends on third-party APIs (YouTube, OpenAI, Anthropic, Google Gemini). Outages or rate limits on these services may temporarily impact functionality.
We are not liable for losses arising from service interruptions caused by third-party APIs, force majeure, or maintenance windows announced in advance.
10. Intellectual property
Polisht's name, logo, website design, code, and original documentation are owned by us and protected under copyright and trademark law. You may not copy, modify, distribute, or commercialize them without our written permission.
Open-source components used in Polisht remain under their respective licenses (notices available on request).
11. Disclaimer of warranties
Polisht is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We do NOT warrant that:
- Using Polisht will increase your YouTube views, subscribers, or revenue
- AI-generated content will be accurate, complete, or fit for your specific purpose
- The Service will be uninterrupted, error-free, or secure
- Third-party APIs (YouTube, OpenAI, Anthropic, Google) will remain available
Specifically: Polisht makes no guarantees about YouTube algorithm performance. The YouTube algorithm is a black box outside our control. View counts, click-through rates, and watch time depend on many factors beyond the optimization signals Polisht improves.
12. Limitation of liability
To the maximum extent permitted by law:
- Polisht's total cumulative liability arising out of or relating to these Terms or the Service is limited to the greater of (a) US$50 or (b) the total amount you paid us in the 12 months preceding the claim
- We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of views, subscribers, revenue, data, or business opportunities
- This limitation applies whether the claim is based on contract, tort, statute, or any other legal theory
Some jurisdictions do not allow these limitations; in such cases the limits apply to the maximum extent permitted by law.
13. Indemnity
You agree to indemnify and hold Polisht harmless from any claims, damages, or expenses (including reasonable legal fees) arising from:
- Your use of the Service in violation of these Terms
- Content you push to YouTube via Polisht that violates third-party rights or law
- Your unauthorized management of YouTube channels you do not own
14. Termination
You may delete your account at any time from the app's settings, which terminates these Terms. We may terminate or suspend your account if you violate these Terms, harm other users, or expose us to legal risk. Upon termination, your right to use the Service ceases immediately. Sections 6, 10, 11, 12, 13, 15, and 16 survive termination.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced via email to active users at least 30 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
16. Governing law and disputes
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-laws principles. Disputes will be resolved exclusively in the courts located in Ontario, Canada, except where local consumer law guarantees you the right to file in your own jurisdiction.
Before filing any lawsuit, you agree to first contact us at hello@polisht.ca and attempt to resolve the dispute informally for 30 days.
17. Miscellaneous
- Severability: If any provision is found unenforceable, the remainder remains in effect.
- No waiver: Our failure to enforce any provision is not a waiver of our right to enforce it later.
- Entire agreement: These Terms and our Privacy Policy constitute the entire agreement between you and us.
- Assignment: You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
